  1. properties of the goods

Our products are predominantly German and international products or objects. All presented products or foods, wines can have allergens. The nature of our products and the mandatory information can be found in the product descriptions above. You are also welcome to contact us personally for more information.

  1. Formation of the contract, delivery reservations, period of validity of the offers

The contract comes into effect when we confirm the order or send the goods.
Hotel & Eventmanufaktur GmbH is entitled to provide the contractual service in partial deliveries if this is reasonable for the buyer. If delivery on call has been agreed, the buyer must call off the goods within a reasonable period of time.
The delivery takes place while stocks last. If a product is sold out, we reserve the right to procure a replacement as far as possible. If it is not possible to procure a replacement, Hotel & Eventmanufaktur GmbH has the right to withdraw from the contract.

When a new price list is published, all previous price lists lose their validity.

3a. Information on contracts in electronic commerce

In the following, we will show you the individual steps with which you can place your binding order in German with us:

  • Based on the product description, you select the item you want and place it using the “add to cart” button.
    Hotel & Eventmanufaktur GmbH is entitled to provide the contractual service in partial deliveries if this is reasonable for the buyer. If delivery on call has been agreed, the buyer must call off the goods within a reasonable period of time.
    The delivery takes place while stocks last.
  • You complete your selection by clicking on the “Proceed to checkout” button.
  • As part of the payment process, you enter your name, your delivery address and your e-mail address, select the desired payment method and enter the necessary information. Please refer to the information for payment types.
  • Your complete order will be displayed again by clicking on the “Continue” button. All information can then be checked again for correctness and corrected.
  • Before placing an order that is subject to payment, you must accept our general terms and conditions and the delivery and payment conditions.
  • The order that has been checked in this way is then finally sent to us by clicking on the “OK” button.
  • You will receive an e-mail confirming receipt of your order. The contract is concluded when the goods are sent to you.
  • You can now call up the order you have sent at any time by clicking on the “My orders” button. The text of the contract will be saved there by us.
  • The terms of delivery and payment as well as the general terms and conditions are available for download.

  1. Prices, delivery and shipping costs, costs for means of distance communication

Please refer to our product description above for prices. The delivery takes place within 7 days after receipt of the order as long as the goods are in stock. The offer is non-binding. Special packaging is carried out at the request of the buyer and against calculation of the additional costs. The minimum purchase is one packaging unit.
The delivery is made by our own truck or by a forwarding agent, parcel service or post. The flat-rate shipping costs can be found on the respective article.

The use of long-distance means of communication incurs costs in the amount of the tariff of your telecommunications provider. We do not offer a service hotline.

  1. Delivery, fulfillment, payment

If the customer is an entrepreneur, the delivery takes place at the customer’s risk and expense. If the customer is a consumer, delivery will be made at the customer’s expense. If the customer is a merchant, our place of business is the place of performance and place of jurisdiction. The delivered goods remain our property until the purchase price has been paid in full.
Payment is net within 7 days. If the due purchase price is not paid immediately after the payment deadline, the consumer has to pay default interest of 5% and the entrepreneur default interest of 8% above the applicable base rate from the day of default. Hotel & Eventmanufaktur GmbH can demand advance payments, partial advance payments or cash payments upon handover.

  1. warranty

If the products delivered by us have obvious defects, including damage in transit, please report such defects to us immediately. However, if you are a consumer, failure to make this complaint has no consequences for your statutory rights.
For all defects in the purchased item that occur during the statutory warranty period, the statutory claims for supplementary performance, for defect elimination/new delivery and – if the statutory requirements are met – the further claims for reduction or withdrawal apply at your choice.

The complaint period ends after 30 days.

  1. Inclusion of general terms and conditions

All offers, contracts, deliveries and other services are supplemented by our General Terms and Conditions of Hotel & Eventmanufaktur GmbH

If the consumer exercises his right of withdrawal, he must pay compensation if the loss in value is due to the handling of the goods that was not necessary to check the nature, properties and functioning of the goods.

You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.
In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail). You can use the attached sample revocation form for this, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation
If you withdraw from this contract, we will have paid you all payments that we have received from you, including delivery costs (except for the additional costs resulting from the fact that you have chosen a different type of delivery than the cheaper standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. The costs are estimated at a maximum of around EUR 50.00. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

  1. Note on the protection of minors

In accordance with the Youth Protection Act, we do not sell wine to young people under the age of 16. Spirits will not be supplied to minors under the age of 18. By submitting the order, the buyer confirms that he is of the required age according to the Youth Protection Act.
